These Terms and Conditions govern the use of this website and the purchase of products from By Aana.
By Aana is a trading name of Malabis Premium FZCO (“Malabis Premium”, “we”, “our”, “us”). When you place an order through this website, you enter into a legally binding contract with Malabis Premium FZCO.
By accessing this website or placing an order, you agree to be bound by these Terms.
1. Eligibility
By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.
2. Products
We take reasonable care to ensure that product descriptions, imagery and pricing are accurate.
However:
- Colours may vary slightly due to lighting and screen settings.
- Measurements are approximate.
- Embellished, embroidered and handcrafted items may contain minor variations due to the nature of materials and production processes. Such variations do not constitute defects.
We reserve the right to modify or discontinue any product without notice.
3. Orders and Acceptance
All orders are subject to availability and acceptance.
An order confirmation email does not constitute acceptance of your order. A binding contract is formed only once your order has been dispatched.
We reserve the right to cancel or refuse any order where:
- A pricing or listing error has occurred
- Stock availability is incorrect
- Fraudulent or suspicious activity is suspected
- These Terms have been breached
Where an order is cancelled, a full refund will be issued.
4. Pricing and Payment
All prices are listed in GBP (£) unless stated otherwise.
Full payment is required at the time of purchase, including for pre-orders.
We are not responsible for currency conversion charges, bank fees or payment provider fees.
All payments are processed by Malabis Premium FZCO.
5. Pre-Orders
Certain items may be offered on a pre-order basis.
By placing a pre-order, you acknowledge and agree that:
- The stated dispatch timeframe is an estimate only.
- Production may begin shortly after your order is placed.
- Once production has commenced, cancellations are not permitted.
- Full payment is required at the time of placing the pre-order.
- Delivery timeframes begin from the date of dispatch, not from the date the order was placed.
If a significant delay occurs beyond the estimated timeframe, we will notify you and may offer cancellation at our discretion.
We reserve the right to cancel any pre-order and issue a full refund in circumstances beyond our control.
6. Shipping, Delivery and Customs
Delivery timeframes are estimates and are not guaranteed.
We are not liable for delays caused by courier services, customs authorities or events beyond our reasonable control.
International orders may be subject to customs duties, taxes or import charges. These are the responsibility of the customer.
If a parcel is refused, unclaimed or returned due to unpaid customs charges, original shipping costs, return shipping fees and any customs-related charges may be deducted from any refund.
7. Returns and Refunds
Our Returns & Refund Policy forms part of these Terms.
Items must be returned:
- Unworn
- In original condition
- With all tags attached
We reserve the right to refuse returns that do not meet these conditions.
Shipping costs are non-refundable unless the item is faulty or incorrect.
8. Altered or Customised Items
Where items are altered, customised or adjusted to a customer’s requested specification, they are non-returnable and non-refundable unless faulty.
9. Faulty or Incorrect Items
If you believe you have received a faulty or incorrect item, you must notify us within 48 hours of delivery.
We may request photographic evidence.
Where approved, we may offer repair, replacement or refund at our discretion.
10. Intellectual Property
All website content, including logos, branding, imagery, designs and text, is the property of Malabis Premium FZCO.
Unauthorised use, reproduction or distribution is prohibited.
11. Limitation of Liability
To the fullest extent permitted by law, our total liability in connection with any order shall not exceed the amount paid for that order.
We shall not be liable for indirect or consequential losses.
Nothing in these Terms excludes liability that cannot legally be excluded.
12. Force Majeure
We shall not be liable for failure to perform any obligation due to events beyond our reasonable control, including but not limited to natural disasters, supply chain disruption, strikes or courier delays.
13. Payment Disputes
If you experience an issue with your order, you agree to contact us directly to allow us reasonable opportunity to resolve the matter before initiating a chargeback or payment dispute.
Initiating a chargeback without prior communication may be considered a breach of these Terms where the claim is unfounded or fraudulent.
We reserve the right to provide evidence to payment providers to defend any disputed transaction.
14. Stock Availability
In rare cases, stock discrepancies may occur due to system or inventory errors.
Where an item becomes unavailable after purchase, we reserve the right to cancel the order and issue a full refund.
