These Terms of Service govern the use of this website and the purchase of products from BY AANA.
BY AANA is a trading name of Malabis Premium FZCO (“Malabis Premium”, “we”, “our”, “us”). When you place an order through this website, you enter into a legally binding contract with Malabis Premium FZCO.
Malabis Premium FZCO is a company registered in the United Arab Emirates, which is our country of domicile. This website is owned, operated and maintained by Malabis Premium FZCO.
By accessing this website or placing an order, you agree to be bound by these Terms of Service.
Eligibility
By placing an order through this website, you confirm that you are at least 18 years of age.
Minors under the age of 18 shall not register as users of the website or transact on it.
Products
We take reasonable care to ensure that product descriptions, imagery and pricing are accurate.
However:
• Colours may vary slightly due to lighting conditions, photography editing or individual device screens.
• Measurements are approximate.
• Embellished, embroidered and handcrafted items may contain minor variations due to the nature of materials and production processes. These variations do not constitute defects.
We reserve the right to modify, update or discontinue any product without prior notice.
Orders and Acceptance
All orders are subject to availability and acceptance.
An order confirmation email confirms that your order has been received but does not constitute acceptance of the order. A binding contract is formed only once your order has been dispatched.
We reserve the right to cancel or refuse any order where:
• a pricing or listing error has occurred
• stock availability is inaccurate
• fraudulent or suspicious activity is suspected
• these Terms have been breached
Where an order is cancelled prior to dispatch, a full refund will be issued.
We also reserve the right to limit or refuse orders at our discretion where necessary to prevent fraud, misuse of promotions or unauthorised resale.
Account Responsibility
Users are responsible for maintaining the confidentiality of their account details, including login credentials.
Any activity conducted under your account is your responsibility. We are not liable for any loss or damage arising from unauthorised access resulting from failure to safeguard your account information.
Pricing and Payment
All prices are listed in GBP (£) unless stated otherwise.
Full payment is required at the time of purchase, including for pre-order items.
We accept payments via major debit and credit cards, including Visa and MasterCard. All transactions are processed in GBP and AED . The price and currency displayed at checkout will be the same as that shown on the transaction receipt. The amount charged to your card may be reflected in your card’s billing currency, depending on your card provider.
We are not responsible for currency conversion charges, bank fees or payment provider charges applied by your payment provider.
All payments are processed securely through authorised payment providers on behalf of Malabis Premium.
Cardholders are responsible for retaining copies of transaction records and for complying with the terms and policies set by their card issuer and this website.
Pre-Orders
Certain products may be offered on a pre-order basis.
By placing a pre-order you acknowledge that:
• the stated dispatch timeframe is an estimate
• production may begin shortly after your order is placed
• full payment is required at the time of purchase
• delivery timelines begin from the date of dispatch rather than the date the order was placed
Once production has commenced, cancellations may not be possible.
If a significant delay occurs beyond the estimated timeframe we will notify you and review available options.
We reserve the right to cancel any pre-order and issue a full refund in circumstances beyond our reasonable control.
Shipping, Delivery and Customs
Delivery timeframes are estimates and are not guaranteed.
We are not responsible for delays caused by courier services, customs authorities or events beyond our reasonable control.
International orders may be subject to customs duties, taxes or import charges imposed by the destination country. These charges are determined by the relevant customs authority and are the responsibility of the customer.
Restricted Jurisdictions
We do not provide products or services to countries subject to sanctions in accordance with applicable laws and regulations, including those enforced by the Office of Foreign Assets Control (OFAC).
Refused or Unclaimed International Shipments
If an international order is refused, abandoned or not collected due to unpaid customs duties, taxes or import charges, the customer will be responsible for any shipping costs incurred, including return shipping fees.
If a parcel is returned to us for this reason, original shipping costs, return shipping charges and any customs-related fees may be deducted from any eligible refund.
Refunds will only be processed once the parcel has been successfully returned to us or the courier confirms that the shipment has been declared lost.
Returns, Exchanges and Refunds
Our Returns, Exchange & Refunds Policy forms part of these Terms of Service and applies to all purchases made through this website.
Where a return is approved, items must be returned:
• unworn
• in original condition
• with all tags attached
Returns that do not meet these conditions may be refused.
Where applicable we may offer an exchange or store credit in accordance with our Returns Policy.
Original shipping costs are non-refundable unless the item received is faulty or incorrect.
Altered or Customised Items
Items that have been altered, customised or adjusted to a customer's requested specification are non-returnable and non-refundable, unless the item is faulty.
Faulty or Incorrect Items
If you believe you have received a faulty or incorrect item, you must notify us within 72 hours of delivery.
We may request photographic evidence to review the issue.
Where a fault is confirmed, we may offer repair, replacement, exchange or refund depending on the circumstances.
Intellectual Property
All content on this website, including logos, branding, imagery, designs, graphics and text, is the property of Malabis Premium.
Unauthorised use, reproduction, distribution or commercial use of any content is strictly prohibited.
Limitation of Liability
To the fullest extent permitted by law, our total liability in connection with any order shall not exceed the amount paid for that order.
We shall not be liable for indirect, incidental or consequential losses arising from the use of this website or the purchase of products.
Nothing in these Terms excludes liability that cannot legally be excluded.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, transport delays, strikes or courier service interruptions.
Payment Disputes
If you experience an issue with your order, you agree to contact us directly so that we may have the opportunity to resolve the matter.
Initiating a chargeback or payment dispute without prior communication may delay resolution where the claim is unfounded or fraudulent.
We reserve the right to provide order documentation, delivery confirmation, policy acknowledgement and customer communication records to payment providers when defending disputed transactions.
Cardholders agree to follow the dispute resolution procedures outlined in these Terms before initiating any chargeback request.
Stock Availability
In rare cases, stock discrepancies may occur due to system or inventory errors.
Where an item becomes unavailable after purchase, we reserve the right to cancel the order and issue a full refund.
Governing Law
Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the United Arab Emirates.
By using this website, you agree that any legal matters shall be subject to the exclusive jurisdiction of the courts of the UAE.
Changes to the Terms of Service
We reserve the right to update or modify these Terms of Service at any time.
Any changes will take effect immediately once published on this website.
